Terms of Use

These terms of use (the Terms), together with our Privacy Policy and our Cookie Policy, govern your use of the Eat Crisps mobile application software (the App) on any mobile telephone or other handheld device.

By downloading or using the App you agree to be bound by these Terms. You should ensure that you read these Terms carefully before using the App. If you do not agree to these Terms, do not download or use the App.

We may amend these Terms from time to time by updating them on our website. We may notify you of such changes via email or through the App.

01 Who we are and how to contact us

1.1. We are Eat Crisps Limited ("Eat Crisps", "we" or "us"). We are a limited company registered in England and Wales with company number 15960309. Our registered office is at 25 Queens Close, Thame, England, OX9 3AZ.

1.2. If you have any problems using the App or need to contact us for any other reason, you can do so by email at support@eatcrisps.com.

02 License

2.1. Eat Crisps provides you with a non-exclusive, non-transferable, non-sublicensable right to access and use the App and any updates or supplements to it, as permitted in these Terms.

03 Your privacy

3.1. Under data protection legislation, Eat Crisps is required to provide you with certain information, including who we are, how we process your personal data and for what purposes, and your rights in relation to your personal data and how to exercise them. This information is provided in our Privacy Policy, and it's important that you read it.

04 Your account

4.1. In order to use the App, leave a review, comment on or like a review, or take any other action in the App, you must first create a user account. Your user account is personal to you and must not be transferred to anyone else. You are only permitted to create one user account.

4.2. You will also be required to choose a username that will be displayed on the App whenever you write a review, comment, or produce any other content. Your username allows you to be identified by others — please note that using your real name could reveal your identity. Your username must not contain anything harmful, defamatory, discriminatory, obscene or illegal.

4.3. You promise that you will keep all information connected with your user account (including your email address) up to date and complete. You can change your username yourself by logging into your account.

4.4. It is your responsibility to keep your Mobile Device and your user account safe and secure at all times. If you know or suspect that anyone other than you has obtained your account information or used your account, you must promptly notify us and change your account information.

4.5. You are responsible for all acts and omissions of any third parties who use or access the App using your account details, whether fraudulently or not, and you agree to reimburse Eat Crisps on demand for any loss we suffer as a result.

4.6. We reserve the right to disable your access to the App at any time, or to delete or filter any content you've produced, if in our reasonable opinion you have failed to comply with these Terms.

05 Your responsibilities when using the App

5.1. You agree that you will:

• use the App in accordance with these Terms;
• not undermine the security or integrity of the App or Eat Crisps' systems;
• not hack into the App or introduce malicious code, such as viruses or harmful data;
• not rent, lease, sub-license, loan, provide, or otherwise make available the App to any person without our prior written consent;
• not modify, copy, adapt, reproduce, disassemble, decompile, reverse engineer or extract the source code of any part of the App;
• not translate, merge, adapt, vary, alter or modify the App, or combine it with other programs, except as necessary to use the App as permitted in these Terms;
• comply with all applicable laws at all times when using the App;
• not write, submit, or be involved in the production of fake reviews — reviews that don't reflect a genuine experience, or that attempt to manipulate consumer perception or negatively target a product or business;
• not do anything misleading or offensive, or infringe the rights of others, or upload material that is defamatory or objectionable;
• not use the App unlawfully, or in any manner inconsistent with these Terms, or act fraudulently or maliciously;
• not infringe Eat Crisps' intellectual property rights or those of any third party;
• not use the App in a way that could damage, disable, overburden, impair or compromise Eat Crisps' systems or security, or interfere with other users;
• not use the App to develop or provide any competing service or functionality; and
• not collect or harvest information or data from the App or Eat Crisps' systems, or attempt to decipher transmissions to or from our servers.

06 Updates to the App

6.1. From time to time we may automatically update the App to improve performance, enhance functionality, reflect changes to the operating system, or address security issues.

6.2. If you choose not to install such updates, or opt out of automatic updates, you may not be able to continue using the App.

07 Third party websites, products or services

7.1. We may use, present to you, and/or link to third party websites, apps, products and/or services through the App. We do not endorse or make any guarantee or promise, and do not assume any responsibility for them. You will need to make your own independent judgement about whether to use or buy any of them.

08 Intellectual property rights and other rights of ownership

8.1. All intellectual property rights in the App throughout the world belong to Eat Crisps (or our licensors), and the rights granted to you under these Terms are licensed — not sold — to you. You have no intellectual property rights in the App beyond the right to access and use it in accordance with these Terms.

8.2. You are not permitted to use any Eat Crisps content, brand, or other content in the App (including reviews submitted by other users) unless we've specifically confirmed in writing that you're authorised to.

8.3. You own, and are responsible for, any content you submit to or transmit through the App. You promise that you have all necessary permissions to create and/or use such content.

8.4. Unless your content is removed by us for violating these Terms, removed or amended by you, or anonymised by us at your request, your content will remain displayed on the App indefinitely.

8.5. By creating, submitting, posting or displaying content on the App, you grant Eat Crisps a licence to use, modify, publish and display that content anywhere in the world, in any way, without restriction and without payment to you. This licence also allows us to make your content available to other companies or individuals, including our customers, for purposes such as syndication, distribution, promotion or publication.

8.6. We appreciate any feedback, ideas and suggestions from you about the App, and may use it forever without restriction or payment to you. If you provide written content or feedback, we can use, quote and/or refer to it at our discretion.

09 Our responsibility for loss or damage suffered by you

9.1. We are responsible to you for foreseeable loss and damage caused by us. If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of us breaking these Terms or failing to use reasonable care and skill — but we are not responsible for loss or damage that is not foreseeable.

9.2. We do not exclude or limit in any way our liability to you, or your liability to us, where it would be unlawful to do so — including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.

9.3. Subject to section 9.2 above, our total liability under or in connection with these Terms, the App or the Service shall not in any event exceed the sum of £50.

9.4. Please back up any content and data used with the App, to protect yourself in case of problems with the App or the Service.

9.5. The App and the Service have not been developed to meet your individual requirements — please check that its facilities and functions meet your needs before relying on it.

10 Matters for which we are not responsible or liable

10.1. We are responsible to you only for foreseeable loss and damage caused to you directly by us. Our aggregate liability to you in any circumstances shall be limited to a total of £50.

10.2. We are not responsible or liable for:

• any business losses — the App is for your personal and private use, and if you use it for any commercial, business or resale purpose we will have no liability for loss of profit, business, business interruption, or business opportunity;
• events outside our control — we do not warrant that your use of the App will be uninterrupted or error-free;
• any delays, delivery failures, or other loss or damage from the transfer of data over the internet or other communications networks; or
• any changes to system requirements imposed by Android, iOS or other app providers — it's your responsibility to install any applicable updates.

11 Termination

11.1. We may end your rights to use the App at any time by contacting you — if we cease to provide the App, if you have broken these Terms in a serious way, or for any other reason. If what you have done can be put right, we will give you a reasonable opportunity to do so.

11.2. If we end your rights to use the App:

• you must stop all activities authorised by these Terms, including your use of the App;
• you must delete or remove the App from all devices in your possession and confirm to us that you've done this;
• we may remotely access your devices and remove the App from them.

11.3. You may choose to delete your user account at any time, and in doing so you will no longer be able to leave reviews on the App. Reviews you've left previously will be anonymised.

12 We may transfer this agreement to someone else

12.1. We may transfer Eat Crisps' rights and obligations under these Terms to another organisation. We will always tell you in writing if this happens, and will ensure that the transfer doesn't affect your rights under the contract.

13 You need our consent to transfer your rights to someone else

13.1. You may only transfer your rights or obligations under these Terms to another person if we agree in writing.

14 No rights for third parties

14.1. These Terms do not give rise to any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of the contract.

15 If a court finds part of this contract illegal, the rest will continue in force

15.1. Each paragraph of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

16 Even if we delay in enforcing this contract, we can still enforce it later

16.1. If we do not insist immediately that you do anything you're required to do under these Terms, or if we delay in taking steps against you for breaking this contract, that does not mean you no longer have to do those things, and it will not prevent us taking steps against you at a later date.

17 Which laws apply to this contract and where you may bring legal proceedings

17.1. These Terms are governed by English law, and you can bring legal proceedings in respect of the products in the English courts. However, if you use the App as a consumer, you may be entitled to bring claims against Eat Crisps in the courts of your country of residence. This section otherwise applies to the maximum extent permitted in your country of residence.
